SEC proposes new rules clarifying crypto asset custody framework for investment advisers and funds
SEC Proposal Would Address How Investment Advisers and Funds Can Custody Crypto Assets Under the Federal Securities Laws
On October 1, 2026, the SEC released proposed rules and amendments to establish a tailored framework for crypto asset custody by registered investment advisers, registered investment companies, and business development companies. The proposal updates custody rules under the Investment Advisers Act of 1940 and the Investment Company Act of 1940, allowing self-custody of crypto assets under specific circumstances, while permitting state-chartered trust companies to serve as custodians of crypto assets for clients and regulated funds. The public comment period will open for 60 days after the proposal is formally published in the Federal Register.
